Dear Judge Brodie:

I am writing to you to express my concerns over the issue referenced above. I have been in the recovery and bail business for approximately 22 years. I have worked diligently to create the law in question. My constituents and I have worked to reform the general pratices and guidelines set by the state of Califronia relating to this industry.

I have seen a lot of hoopla in referance to " The Dog " and his blatant slander in describing himself as the bounty hunter who caught the internation rapist, Mr. Luster.

On Mr. Chapman's web site. (www.dogthebountyhunter.com) The Dog, by his own admision states that he is a convicted felon with a prison record. One of his 18 convictions is a drug related murder.

I ask you to reveiw the laws when it comes to Mr. Chapman and his own admissions. The declaration of Alice Smith and her endorcement for Mr. Chapman for Mr. Chapman to investigate this case is in violation of P.C. 1299.11. Her attestation to Chapman's investigation of Luster in California puts Mr. Chapman in violation of P.C. 1299.01(D), P.C. 1299.04, and P.C. 1299.11. I aske the court to request from Mr. Chapman his credentials and his D.O.J. background investigation and clearance. I also ask the court to verify the statice of Alice Smith's license with the Department of Insurance in the states of California, Hawaii, and Colorado.

If the State of California issues payment to " The Dog " this is condoning his illegal activity and authorizing him and others to break the law ( P.C. 1299.11 ). Mr. Chapman's motion for recovery fee's is an extortion like tactic. $320,000.00 is an exorbitant amount of money for being tipped off. Rewarding his illegal conduct in this manner will flood the industry and our streets with freelance criminals who will motion the courts for bounty.

As it's well known the Bail Industry supports bail enforcement, However Chapman and his follower's actions, will have civil and criminal ramifications that will cost the taxpaying citizens.

I pride myself in my work and efforts to bring regulations and order to a historically unorganized and potentially violent industry. Mr. Chapman's actions are not condoned by this industry or the professionals who work it. In my 22 years of Bail Enforcement I have closed several thousands of cases. All... incident free and done with in the scope of the law.

Dear Judge Brodie,


I have been a bail enforcement agent for 19 years with several international captures to my credit and I’ve testified before my state's Legislature on two occasions in quest of reforming the bail industry in my state. As a result a law was passed with stringent requirements for anyone wanting to enter the field. It is situations like the Chapman/Luster fracas that serves to set bail enforcement back several years because of Mr. Chapman’s ongoing criminal activities as he claims to be a ‘bounty hunter’. In Mr. Chapman’s case, he wasn’t even acting in the capacity of a bounty hunter… he operated only as a self-proclaimed vigilante. There was no bounty to begin with. It is my understanding that Mr. Luster had posted his own bail which makes him the surety.

California requirements under their licensing procedures for bounty hunters include a provision that no one with a felony conviction can operate as a recovery agent in the State of California, [PC 1299.04(a)(1)-(5)]. Duane Lee Chapman is a multi-count felon. Additional California law requires completion of a 40-hour power of arrest course [PC 1299.04(a)(2)], completion of a minimum of 12 hours classroom education pursuant to IC 1810.7 [PC 1299.04(a)(3)] and completion of a training course in the exercise of the power to arrest pursuant to Section 7583.7 of Business and Professions Code [PC 1299.04(a)(4)]. Mr. Chapman has not completed any of the training requirements.

Chapman’s illegal and violent apprehension of Andrew Luster has been much publicized by the media he so loves to exploit. Duane Lee Chapman is merely an out-of-control vigilante conducting criminal activities who has placed yet another negated stigma on the bail enforcement profession. The focus of Luster’s capture is somewhat distorted knowing the apprehension was accomplished with the application of additional criminal acts on an international level.

The Court in Reese v. United States has made it clear what American bounty hunters (to include vigilantes) may not do is pursue their quarry across international borders. An American bounty hunters ‘power of arrest can only be exercised within the territory of the United States.’

Duane Chapman is a prime example of what the bail industry in general is endeavoring to eliminate. The old west style of outlaw bounty hunter has long dissipated in the wake of nationwide legislation requiring licensing and training. The ‘Dog’ Chapmans and been replaced with trained and adept professional bail enforcement agents who are responsible for approximately 40,000 fugitive arrests each year without incident and devoid of any liability without costing the taxpayers one single dime.
