Sherry: Thanks for the backup!!! The only issue between Y k and me is re: the CONVICT who refuses to be a law abiding citizen, NOT whether I would allow someone to date Mr. Luster. My Luster is entitled to a fair trial where ALL evidence is admitted. That hasn't happened, YET...

ROFLMAO! I can think of a lot of ways he will get around it. Remember, once he gets a new trial, the prosecution is not going to have their star witness Tonjia to lie to the jury this time. When she is removed, there is very little left to bring a case on considering the other 2 "witnesses" credibilty is in question now too. Remember there was no tape of Carrie, only her word as to what took place. That leaves Shawna and her less than convincing performance on the one tape left. Both Shawna and Carrie had serious credibility issues going in, thus the inclusion of Tonjia in the first place. That's just what is public now. The lawyers will hire P.I.'s to investigate and dig up more yet. There are many appellate issues that will overturn the verdict and there is always the challenge that the law didn't apply in this case in the first place. Eat it, ST.

lmao truth its a long uphill battel for luster right now,like i said hope he dose get his appale rights back.But right now the civil case is going on,and shawna doe testified yerster day.Evidence inclued luster criminal convictions,a deposition from his client's therapist and a copy of the rape tape.

Anybody can hire a therapist to say anything they're paid to say and as far as the tapes go, all Drew has to do is introduce the one where she looks into the camera and asks how her hair looks, and supplemenmt with the portion of the trial transcript where she is found to be incredible on the GHB as well. If it's such a slam dunk, why doesn't he even need a lawyer? Post the link on the info about yesterday's testimony if it's so d**ning.

sherry No attorney was present for luster,and he can't make it over to the court right now.Maybe you can run that tape over?After all the judge will issue a ruling in the next few days.

VENTURA – Convicted rapist Andrew Luster, who was recently captured in Mexico by bounty hunters, faces civil lawsuits from three women who say they were sexually assaulted by the cosmetics heir.
Two women whom Luster knocked out with sedatives and raped in front of a video camera are scheduled to go to trial next month. Another woman also filed a lawsuit last month, claiming she was drugged and raped by the great-grandson of cosmetics magnate Max Factor.
Luster, 39, jumped his $1 million bail and spent nearly six months on the run until he was captured last week in Puerto Vallarta. He was returned to California to begin serving a 124-year prison sentence for drugging and raping three women at his home.
The most recent civil suit was filed against Luster by a Placer County woman who said she learned five months ago that detectives found sexually explicit photographs of her during a July 2000 search of Luster's home. The pictures were shown to jurors during Luster's trial, but the woman had not been identified yet.
The woman, who seeks $10 million in damages, now believes Luster drugged, raped and photographed her in sexual poses.
Prosecutors said Wednesday that law enforcement officials are investigating whether the woman was a fourth victim.
Earlier this week, judges presiding over the two other civil cases issued separate orders demanding that Luster appear for depositions at Wasco State Prison, where he is being held.
Because Luster was a fugitive, jurors in a civil trial will be allowed to consider not only his criminal conviction but also his failure to respond to court papers in the case.
Some of those filings include a prepared list of more than 40 admissions that say Luster is worth more than $20 million and that he drugged and had forced sex with his victims.
Luster did not respond to the list because he was a fugitive. The judge granted an attorney's ruling to deem the admissions true for purposes of trial.

Luster Victim Testifies in Civil Court
The woman, 23, is one of two from the Ventura County criminal trial who are now suing the convicted rapist for damages.

One of Andrew Luster's rape victims testified during an hourlong civil trial Monday, telling a judge that the wealthy playboy ruined her life when he drugged and sexually assaulted her in front of a video camera.
The woman, identified as Shawna Doe, testified that she was unaware she had been raped until detectives investigating an unrelated sexual assault showed her a videotape of the incident.
The tape, labeled "Shawna GHBing," was found three years ago during a search of Luster's beach home in Mussel Shoals. It shows him undressing her and twice engaging in sexual intercourse as she lies unconscious on his bed.
The 23-year-old victim, who is now suing Luster for millions of dollars in damages, testified Monday that the images are seared in her memory and have led to ongoing therapy for depression and anxiety.
"I don't remember the last time I was genuinely happy," she said, crying. "There is not a day that goes by that I don't remember what's on that video. It's really disturbing."
Luster, the 39-year-old great-grandson of cosmetics legend Max Factor, was convicted in January of raping three women, including Doe, after knocking them out with a potent anesthetic known as gamma hydroxybutyrate, or GHB.
Two of the victims sued and are seeking unspecified damages for assault, intentional infliction of emotional distress and humiliation. Doe's case is the first to go to trial.
On Monday, Beverly Hills attorney Barry Novack called her as his sole witness and submitted the case on evidence that included Luster's criminal conviction, a deposition from his client's therapist and a copy of the rape videotape.
No attorney was present for Luster, who is serving a 124-year sentence at a state prison near Salinas. Civil attorney Frank Lizarraga left the case in May, four months after Luster fled his criminal trial and was declared a fugitive. Luster was apprehended in Mexico in mid-June.
During his five months on the run, Luster failed to respond to civil filings in the two cases, including requests for information about his finances.
Luster also failed to respond to a list, prepared by Novack, of 42 alleged admissions, including assertions that he is Factor's great-grandson, that his net worth is more than $20 million and that he drugged Doe and forced sex on her while she was unconscious.
With no response from Luster, Novack asked Ventura County Superior Court Judge Fred Bysshe to deem the admissions true for purposes of trial, and Bysshe agreed. The judge is expected to issue a ruling in the case in the coming days.

There are reasons they only used Shawna for the civil suit. It doesn't mean she is any more truthful than the other two. I still don't see how she can plead damages against Luster when he didn't release the tape. It was confiscated and her only "damages" seem to be of her own doing or those of the prosecution or media. They couldn't allow Tonjia on the stand and how she is even named is beyond me. She does more damage to their case than any defense lawyer could hope to. I just can't figure out why the hell he isn't responding. It just adds to the whole mystery here and the speculation that the whole thing may have been staged. Maybe the explanation is as simple as he can't answer on one thing without answering others like his finances, still, it's such an opportunity for discovery. He could do it pro se', at least the depos.
